ALBANY, N.Y. - A group representing landowners across the Southern Tier filed a lawsuit today against Governor Cuomo and other state officials for failing to make a decision on fracking.
The lawsuit by the Joint Landowners Coalition of New York was filed in State Supreme Court.
In addition to Cuomo it names the commissioners of the State Health Department and Department of Environmental Conservation.
The lawsuit is asking the court to order the DEC to finalize the environmental impact statement which guides the permitting process for fracking. It's been under review for over six years.
The lawsuit also says Cuomo is orchestrating the delay and interfering with the DEC's independent decision making authority.
