Elmira man charged for summer ATV accident that left girl injured

Edward Fitzwater of Elmira has been charged after an ATV accident over the summer left a young girl seriously injured.

According to the Chemung County Sheriff’s Office, Fitzwater was driving an ATV on Shady Knoll Drive in Big Flats on August 4, 2018, when a 10-year-old passenger fell off and suffered serious injuries.

Neither Fitzwater nor the girl was wearing a helmet, and the ATV was not registered.

Fitzwater has been charged with Endangering the Welfare of a Child, a Class A Misdemeanor and the following Vehicle and Traffic Law Violations: Operating an ATV on a public highway, uninsured ATV, unregistered ATV, operating an ATV without a helmet, operating an ATV with a passenger, and reckless operation of an ATV.

Fitzwater has been issued appearance tickets and is scheduled to appear in the Town of Big Flats Court at a later date to answer the charges.
