First Arena to remain open amid code violations


UPDATE: Elmira City Manager Mike Collins tells 18 News that First Arena tennant Robbie Nichols has continued to work with code enforcement and “at this time, the First Arena will remain open and Elmira College commencement will be there this weekend.”


Chemung County Executive Christopher Moss has released a list of code violations found at First Arena during an inspection on Nov. 13, 2018.

During an annual fire inspection on May 16, 2019, the same violations were present according to letters from the fire marshal and code enforcement.

The letter sent to 18 News indicates that as of May 23, 2019 “First Arena will be posted “Not to Occupy” due to the reasons below.”

  • Crash bar for Exit, Gray St. side of building, inoperable
  • Extension cord used to plug in the quarter’s machine in front, Gray St., shall be removed
  • Tool chest in hallway near lockers shall be removed
  • Emergency Exit at fire panel is blocked
  • Emergency Exit at sprinklers room is blocked
  • Sprinkler shut-offs are blocked
  • Emergency Exit at section 102 is blocked
  • Smoke detectors are not mounted at concessions by section 102
  • Fire Extinguisher is missing in hall by suite 29
  • Fire Extinguisher is missing on south wall by section 101
  • Fire Extinguisher is missing in concessions by section 116
  • Chained Exit doors in 
    • Bar area
    • Main Street side
    • North End of building
    • Gray Street side
  • Inspection cooking hoods are out of date due to no inspections by a certified cleaning service and electrical tape must be removed from electrical breaker panels
  • Carbon monoxide detectors missing
  • Fence broken on Gray St. side of building
  • Boilers inoperable and no certified inspection report for the boiler shown
  • No fire alarm inspection report shown

The letter notes that Robbie Nichols, the owner of the Elmira Enforcers who leases the building during hockey season, has had “ample time to correct said violations.”

First Arena has until close of business on Thurs. May 30 to address the issues.
