An Elmira man facing felony drug charges may be getting a break from the judge.
32-year-old Santee Thomas was arrested in April of this year after police found him with 100 grams of cocaine, more than a pound of marijuana, narcotic paraphernalia, and a large sum of cash.
The standard sentencing for these crimes is three and a half years in state prison but because Thomas has no prior convictions and has stayed out of trouble since his arrest, Chemung County Court Judge Richard Rich says he plans to sentence Thomas with probation instead if he stays out of trouble until his next court appearance.
Judge Rich acknowledging his decision will probably be met with criticism from some.
Thomas is to appear back in court on December 22nd.
