First it was a food supplier accusing Andrew Sample of failing to pay, then an employment service company, and now employees who say they still haven’t gotten their checks.
18 News Reporter Samantha Lantz has been following this story from the beginning and brings us the latest after another day in court.
Just one month ago Sample stood before Judge Craig Banfield in Horseheads Town Court and promised to pay thousands of dollars in back pay to his former employees by Wednesday’s court date.
Wednesday morning Sample was back in the same court room, but with a different judge. After a few short moments, the case was adjourned as employees wait to be paid.
“He was told today was the deadline to pay us and he hasn’t paid me nothing,” An anonymous employee said.
After months of being closed with still no pay, former employees of Sample This Barbecue say enough is enough. The ones we spoke to say they’re owed hundreds.
“We came in here today hoping to get that because the judge said if he doesn’t pay us in full, all of our employees, that he’s gonna be going to jail so we come in here today and he gets an adjournment for a whole other month,” Former employee Ivan Lopez said.
Employees say that’s another month they’re left to try to make ends meet to pay their own bills.
“Now I got to start from the bottom again and just work my way up,” Lopez said.
“I do have bills to pay, it’s a struggle but I’m getting by. Hopefully next time he’ll have my money,” Said another employee.
Lopez isn’t as optimistic.
“He’s a scammer. He doesn’t care about anybody but himself, he doesn’t care about his employees, if he did he would pay,” Lopez said.
Meanwhile, Sample’s wife Stephanie also made an appearance before the judge Wednesday. She’s facing felony charges after writing a bad check.
Andrew and Stephanie Sample are due back in court on November 14th at 9am. The couple also allegedly owes $99K to Adecco, an employment services company out of Corning. 18 News is continuing to follow that case as well.
