UTICA, N.Y. (WSYR-TV) - The family of Kevin Ward Jr. and Tony Stewart have reached a settlement outside of court in the wrongful death suit against Stewart.
Five weeks before trial, both parties told the court that they have reached a settlement.
However, the April 12 hearing to have the settlement discussed "on the record" will no longer take place as both parties filed a motion asking the court to vacate the in-person settlement.
Thursday's hearing would have resulted in "inconvenience and significant costs" to both parties, according to the motion filed.
The settlement was reached outside of court, and Ward's parents and Stewart wanted to keep the terms of the settlement confidential.
The settlement will be handled through Surrogate's Court.
Ward's family brought a civil lawsuit against Stewart following their son's death in 2014.
Ward was killed at the Canandaigua Motorsports Park when he was struck by Stewart's car.
