Law Talk: Case closes on body found in dumpster in Elmira’s Southside

Law Talk Feature

This week, Matthew Buzzetti, an attorney at the Law Office of Kevin P. Flynn discussed the case 18 News reported back in 2018 about a body found in a dumpster.

The case closed and two charges of criminally negligent homicide were dismissed Wednesday morning after the county court judge ruled insufficient evidence that wasn’t speculative to warrant criminal action against Buzzetti’s client and co-defendant.

An empaneled jury was unable to rule on a verdict due to the judge’s decision despite the vast evidence they went through from the District Attorney’s office including witnesses, videotapes and the medical examiner’s testimony.

Towards the end of February 2018, two individuals were charged with two counts of criminally negligent homicide and another individual charged with assault, a misdemeanor.

The case made its way through court proceedings ending with a trial last week on the two counts of homicide.

Wednesday morning all charges and the case was dismissed by the county court judge.
